Payment

The purchase price may be paid by credit card (stripe.com), E. banking (Paysera), cash on delivery (COD), bank deposit. The Seller reserves the right to exclude individual payment methods and refer to other payment methods, or to introduce further payment methods.

The Seller accepts credit cards from the companies VISA, MasterCard and American Express, among others. Processing is carried out via an external payment service provider. After entering the credit card data, an additional confirmation mask of the bank with all payment data is displayed. The member must go through the respective authentication procedure of his bank and can confirm the credit card payment by entering a security code afterwards. Further information on the authentication procedure can be obtained from your bank. The Member is liable for any additional costs arising through his fault in the use of his chosen payment method, for example by chargeback. If the Member is paying by credit card, the Seller will debit the purchase price after it receives the order.

When choosing the payment method Paysera, the buyer is automatically redirected to the Paysera site at the end of the order process. There the buyer can choose on the many payment’s methods via e-banking directly or register directly to Paysera and follow the payment instructions of Paysera. The Paysera account will be charged directly with the corresponding purchase amount.

When choosing the payment method (COD) Pay directly to the courier or when you pick up your parcel. This payment method is only available in Lithuania, Latvia and Estonia and if you choose delivery via DPD post offices or DPD couriers.

1. General provisions

These rules for the purchase and sale of goods (hereinafter - the Rules) are a binding legal document for the Buyer and "MB Silueti" (hereinafter - the Seller), which determine the rights and obligations of the Parties, the conditions and procedures for the conclusion of the Purchase and Sale Agreement, delivery and return, as well as other provisions related to the purchase and sale of goods in the SILUETI online store at https://silueti.shop/.
These Rules are prepared in accordance with the Civil Code of the Republic of Lithuania, the Law on the Protection of Consumer Rights of the Republic of Lithuania and other applicable legal acts.
When ordering goods, the buyer confirms that he has familiarized himself with the Rules.
www.silueti.shop has the exclusive right to order and buy goods only:

- able-bodied natural persons, that is, persons who have reached the age of majority, whose capacity is not limited by court order;
- minors between the ages of 14 and 18, only with the consent of their parents or guardians, except in cases where they dispose of their income independently;
-legal entities. However, the conditions for returning goods and canceling the contract described in these Rules do not apply to legal entities; they can return the goods only on the grounds established in the general Lithuanian legal acts.

2. Conclusion of the purchase-sale contract

The contract between the Buyer and the Seller is considered to be concluded when the Buyer, after choosing the product(s) to be purchased and creating a shopping cart (hereinafter referred to as the Shopping Cart), clicks on the "ORDER" link.
Upon conclusion of the Purchase-Sale Agreement, the assortment of goods, their quantity, price, delivery time and other conditions specified during the execution of the Buyer's order are binding on the Buyer and the Seller, and can only be changed in accordance with the procedure set forth in these Rules.
Purchase-sale contracts are registered and stored in the Seller's database.
All items sold on the site are for personal use only and may not be resold or otherwise transferred for commercial purposes. Transferring the purchased product to another container, dividing it into parts or otherwise using it outside of the original packaging, when it is done for the purpose of reselling the product, is a gross violation of the manufacturer's intellectual property, which is subject to both civil and criminal liability. 3. Buyer's rights and obligations

The buyer has the right to buy goods in the online store www.silueti.shop in accordance with these Rules.
The buyer has the right to withdraw from the purchase-sale agreement concluded with the online store www.silueti.shop by notifying the seller in writing (by e-mail, indicating the desired return item and its order number) no later than within 14 (fourteen) days from the quality of the item delivery days. This right to refuse the goods within 14 days applies only to consumers (natural persons who purchase goods for consumption purposes unrelated to their business, trade, craft or profession). Legal entities and other Buyers who do not meet the concept of user may return goods only on the grounds established by the general laws of Lithuania.
The Buyer's (consumer's) right discussed in the first sentence of point 3.2 of the Rules is implemented in accordance with the Civil Code of the Republic of Lithuania 6.228 ¹⁰
The Buyer's (consumer's) right discussed in point 3.2 of the Rules can be used by the Buyer only if the product has not been damaged or its appearance has not fundamentally changed, as well as if it has not been used. (for details, see Part 8 of the Rules).
Having purchased a low-quality product, the Buyer has the rights provided for in the legal acts of the Republic of Lithuania.
It is not possible to cancel or adjust the created and ordered Shopping Cart. In the event that the Buyer has already placed an order, in order to cancel or correct the order, the Buyer should immediately contact the Seller (for contact details, see Part 9 of the Rules). In cases where the Seller does not have the possibility to grant the Buyer the right to cancel or adjust the basket of ordered goods (for example, because the goods have already been prepared for shipment or handed over to the courier), the Buyer retains the right to withdraw from the contract and return the Goods in accordance with the procedure set out in these Rules.
After placing an order, the Buyer must accept the goods in accordance with the procedure set out in these Rules, as well as not abuse the Buyer's rights and comply with the requirements of legal acts.
If the Buyer, during the delivery of the goods, refuses to accept the goods without valid reasons, the Buyer must cover the costs of returning the goods at the Seller's request

4. Seller's rights and obligations

The Seller undertakes to enable Buyers to order goods through www.silueti.shop in accordance with the procedure set forth in these Rules.
The seller undertakes to deliver the goods purchased by the buyer to the address and method chosen by the buyer when ordering the goods.
The Seller undertakes to respect the Buyer's privacy and to process his personal data in accordance with the requirements of valid legal acts.
The Seller undertakes to make maximum efforts to fulfill the Buyer's order. However, in exceptional cases, unique situations may occur when, due to unforeseen circumstances beyond the control of the Seller, the Seller cannot deliver the goods purchased by the Buyer. In such exceptional cases, if it is not possible to fulfill the Purchase-Sale Agreement, the Seller has the right to terminate the Purchase-Sale Agreement by notifying the Buyer beforehand. In order to satisfy the Buyer's needs, the Seller can offer the Buyer a product similar to the one ordered or purchased by the Buyer. If the buyer refuses, the seller undertakes to return the money paid to the buyer within 5 working days.
In the event that the Buyer (user) exercises his right to withdraw from the contract in accordance with Clause 3.2 of the Rules, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) days from the day he received the Buyer's notice of withdrawal from the contract. The Seller may not refund the amount paid to the Buyer until the goods are returned to the Seller or until the Buyer provides proof that the goods have been sent to the Seller, whichever occurs first.
When the Buyer, when placing an order via www.silueti.shop, chooses to pay for the goods by picking up the goods or has paid for the goods when placing the order, but the Seller's partner (the delivery company whose delivery the Buyer has chosen), seeking to deliver the ordered goods to the Buyer, fails to contact the Buyer via On the website of the seller's partner, the deadline set by the procedure is publicly announced by the contacts specified by the Buyer, then the goods ordered by the Buyer are returned to www.silueti.shop.

5. Payment of product prices and orders

The prices of goods in the online store and in the formed order www.silueti.shop are indicated in euros. The seller is a VAT payer. VAT is included in the product prices listed on www.silueti.shop. Before the Buyer confirms the order, the delivery fee is added to the total amount of the goods.

6. Procedure and terms of payment for goods.

The buyer pays for the purchased goods in one of the following ways:

- By electronic banking: directly - Paysera, bank cards, cash on delivery (COD) or bank transfer.
-The buyer, paying through electronic banking, undertakes to pay for the goods immediately. Only after he has paid, the goods parcel will be formed. If the order is not paid within 1 hour, the order is removed from the system.

7. Delivery of goods

When purchasing goods in the online store www.silueti.shop, the buyer chooses the method of delivery of the goods;
The buyer, having chosen the goods delivery service, undertakes to provide the exact delivery address of the goods;
The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the address specified by the Buyer and based on other data provided by the Buyer, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity;
The goods can be delivered by the Seller himself or his authorized representative;
The delivery fee is calculated after choosing the delivery method.

Delivery fee is applied per order.
The buyer will see the exact amount of the shipping fee before confirming the order. The amount of the delivery fee will not be changed after the order is confirmed.
The Seller undertakes that the purchased goods will be delivered as soon as possible, but no later than within the term of delivery of the goods specified by the Seller.
The Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the Buyer's fault or due to circumstances beyond the Buyer's control.
After receiving the goods, the Buyer must, together with the Seller or his authorized representative, check the condition of the shipment (whether the outer packaging is not damaged) and sign the invoice, waybill or other shipment transfer and acceptance document. After the buyer signs the invoice, bill of lading or other document of delivery and acceptance of the shipment, it is considered that the shipment has been delivered in proper condition.
Having noticed that the package of the delivered package is damaged (crumpled, torn, wet or otherwise externally damaged), the Buyer must note this in the invoice, waybill or other document of delivery and acceptance of the package and, in the presence of the Seller or his representative, draw up a free-form package violation act. If the Buyer does not perform these actions, the Seller is released from responsibility for damage to the goods, if the basis for the occurrence of such damage is not a factory defect, and for inconsistencies in the composition of the goods, if these inconsistencies can be determined by inspecting the outside of the goods.
If the Buyer, upon receiving the shipment, notices a discrepancy in the goods, a factory defect or other defects in the goods, he shall inform the Seller immediately (no later than within 24 hours of receiving the shipment). If the complaint about the inappropriate quality of the goods is confirmed and the Buyer returns the goods of inappropriate quality, the Seller undertakes to return the money for the goods within 14 (fourteen) days, while also covering the return costs. In any case, this does not limit the Buyer's rights in the event of the purchase of a product of inappropriate quality, which are established by law.
Buyers must immediately inform silueti.shop after collecting parcels from DPD post machines and noticing discrepancies (for contact details, see Part 9 of the Rules).
The characteristics of all goods sold are indicated in the description attached to each item. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store www.silueti.shop may not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
If the buyer (user) cancels the contract of sale of goods (i.e. using the right to return a quality item within 14 days), the amount paid for the goods is returned to the buyer, excluding delivery costs.

8. Return of goods

Quality goods purchased by the buyer (user) can be returned within 14 days from the day of receipt.
It should be noted that quality cosmetic products cannot be exchanged or returned - the legal basis of the Government of the Republic of Lithuania in 2001. June 11 Resolution no. 697 "On approval of retail trade rules" and Article 6.362, paragraph 4 of the Civil Code of the Republic of Lithuania.
Defects of sold low-quality goods are eliminated, low-quality goods are exchanged, returned in accordance with the provisions of the Civil Code of the Republic of Lithuania and other applicable legal acts.
You can find the list of non-returnable goods: 2012 March 15 Order of the Minister of Economy of the Republic of Lithuania No. 4-243 (Zin., 2012, No. 34-1637) "On approval of the rules for returning and exchanging items" in point 17.
In order to return the product(s), the Buyer informs the Seller by e-mail info@silueti.eu The letter indicates the order number, the reason for the request and the Buyer's contact information. The buyer must provide several photos of the product from all sides of the product, proving that the packaging of the product (product) has not been damaged, opened or used by the buyer.
The following conditions must be met when returning goods:
The returned item must be in its original, neat packaging (this clause does not apply in the case of returning a defective item);
The product must be undamaged by the Buyer;
The product must be unused, without losing its commercial appearance (this clause does not apply in the case of returning a defective product). The buyer cannot exercise his right to return a quality product if its protective cellophane film (cellophane outer packaging), protective sticker or other similar protective device preventing the possibility of opening the product's bottle, vial, container or other product container has been torn or damaged and/or use this product.
The returned quality product (within 14 days) must be in the same package as the one received by the Buyer (this clause does not apply in the case of returning a low-quality product);
The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met;
In the case of returning quality goods, the Buyer must pay the costs of returning such goods. The Buyer can return quality goods in one of the ways specified by the Seller in these Rules within 14 (fourteen) days from the day of receiving the goods.
When the Buyer returns a quality product, the cost of returning it will be deducted from the amount returned by the Seller to the Buyer.
If a defective product is returned, the return does not cost the Buyer - these costs are covered by the Seller.
The return and exchange of goods of suitable quality is carried out in accordance with Article 6.228 ¹⁰ of the Civil Code of the Republic of Lithuania;
The Seller is not responsible for the incomplete or delayed order for the returned goods, if the Buyer incorrectly provides the data required for the return.
Money for returned goods is returned within 9 days from the day the goods are delivered to the Silueti warehouse.

9. Exchange of information
The Seller provides information to the Buyer and, if necessary, otherwise communicates with him using the e-mail provided in the Buyer's registration form. e-mail address, and the Buyer can use all communication channels specified in the "CONTACTS" section of the website of the online store www.silueti.shop (link: https://silueti.shop/kontaktai/ ).

10. Liability

The buyer is fully responsible for the correctness of the data provided in the registration form. If the Buyer provides inaccurate data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation for the direct losses suffered by the Buyer.
The buyer is fully responsible for his actions after registering at the online store www.silueti.shop.
The buyer is responsible for the security of his registration data. If the registration data is used by a third party, he will be considered the Buyer.
The Seller is released from any liability in all cases where losses occur due to the Buyer's failure to familiarize himself with these Rules, regardless of the Seller's recommendations and his obligations (although he was given such an opportunity).
In the event of damage, the guilty party compensates the other party for the losses incurred in accordance with the procedure and grounds established by the legal acts of the Republic of Lithuania.
The parties are released from responsibility for full or partial non-fulfillment of their obligations under these Rules, if they prove that the obligations were not fulfilled due to circumstances that they could not control and reasonably foresee at the time of the conclusion of the Agreement, and that they could not have prevented the occurrence of these circumstances or their consequences. According to these Rules, circumstances of force majeure are understood as defined in Article 6.212 of the Civil Code of the Republic of Lithuania. and in the rules of Exemption from liability in case of force majeure approved by the resolution of the Government of the Republic of Lithuania. In the event of force majeure, the Party requesting exemption from liability must notify the other Party of the Agreement in writing as soon as possible. If the circumstances of force majeure continue for more than 3 (three) months, the Agreement may be terminated at the initiative of one of the Parties, after notifying the other Party in writing.

11. Final Provisions

The seller reserves the right to suspend, at its own discretion, fill in, change these Rules and other documents related to the Rules. Additions or changes to the rules take effect from the date of their publication.
If the Buyer does not agree with the new version of the Rules, partial additions, changes, the Buyer has the right to refuse them, on the condition that the Buyer loses the right to continue buying goods at www.silueti.shop. The version of the Rules valid at the time of the order is applied to the Buyer's orders submitted before the amendment of the Rules.
These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
